These Terms and Conditions ("Terms") govern the hire and sale of shoring equipment by ASC Shoring Pty Ltd ("ASC Shoring", "we", "us", "our") to you ("Customer", "you", "your"). By placing an order for hire or purchase of equipment, you agree to be bound by these Terms.
ASC Shoring reserves the right to update these Terms at any time. The most current version will always be available on our website. Continued use of our services following any changes constitutes acceptance of the revised Terms.
2.1 Hire Period: The hire period commences on the date the equipment is delivered to the nominated site and concludes on the date the equipment is collected by ASC Shoring or returned to an ASC Shoring depot.
2.2 Minimum Hire Period: A minimum hire period of five (5) business days applies to all hire orders unless otherwise agreed in writing.
2.3 Hire Rates: Hire rates are as quoted at the time of booking. ASC Shoring reserves the right to vary rates with 30 days' written notice for ongoing hire arrangements.
2.4 Extension of Hire: If you wish to extend the hire period, you must notify ASC Shoring at least 24 hours before the scheduled return date. Extensions are subject to equipment availability.
2.5 Early Return: Equipment returned before the end of the agreed hire period will be charged for the minimum hire period or the actual period used, whichever is greater.
The Customer is responsible for:
4.1 Damage Assessment: Upon return of hired equipment, ASC Shoring will conduct a damage assessment. The Customer will be charged for any damage beyond normal wear and tear.
4.2 Loss or Theft: In the event of loss or theft of hired equipment, the Customer is liable for the full replacement cost of the equipment.
4.3 Customer Liability: The Customer accepts full responsibility for any damage to property, injury to persons, or other loss arising from the use of hired equipment during the hire period.
4.4 Limitation of Liability: To the maximum extent permitted by law, ASC Shoring's liability to the Customer for any claim arising from these Terms is limited to the total hire fees paid in the three months preceding the claim.
5.1 Account Customers: Approved account customers are subject to net 30-day payment terms unless otherwise agreed in writing.
5.2 Non-Account Customers: Payment is required in full prior to delivery or collection of equipment.
5.3 Late Payment: Overdue accounts will attract interest at the rate of 2% per month on the outstanding balance. ASC Shoring reserves the right to suspend hire services for accounts in arrears.
5.4 Disputed Invoices: Any dispute regarding an invoice must be raised in writing within 7 days of the invoice date. Undisputed portions of invoices remain payable by the due date.
ASC Shoring will use reasonable endeavours to deliver equipment on the agreed date. However, delivery dates are estimates only and ASC Shoring is not liable for any loss arising from late delivery. The Customer is responsible for ensuring safe and suitable access to the delivery site.
All ASC Shoring equipment is certified to Australian Standard AS 4744 — Steel Shoring Systems. Engineering documentation is provided with every hire or purchase. The Customer is solely responsible for ensuring that the equipment is used in a manner that complies with all applicable safety legislation and standards.
ASC Shoring may terminate a hire agreement immediately if the Customer breaches any of these Terms, becomes insolvent, or uses the equipment in an unsafe or unlawful manner. In such circumstances, the Customer must return the equipment immediately at their own cost.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
